1. Agreement to Terms

By using or accessing the Service provided by Duchas (via website, mobile app or other interface), you ("User") accept and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into a contract. By agreeing, you represent that you meet these requirements.

3. License & Use of Service

• Duchas grants you a non-exclusive, non-transferable, revocable license to use the Service for your personal or authorized business purposes, in compliance with these Terms.
• You agree not to misuse the Service (e.g., no hacking, reverse engineering, unauthorized access, distribution, replication, or sale).

4. Acceptable Use & Prohibited Conduct

You agree not to use the Service for any unlawful, abusive, fraudulent, or harmful purpose. Prohibited uses include (but are not limited to):

• Harassment, hate speech, defamation, or illegal content.
• Uploading or transmitting viruses, malware, or other harmful code.
• Interfering with the operation, security, or integrity of the Service or its infrastructure.
• Attempting to circumvent security measures or access unauthorized data.

5. Intellectual Property

• All intellectual property rights (software, design, documentation, trademarks, logos, content, etc.) are owned by Duchas or its licensors.
• You may not reproduce, distribute, reverse engineer, or create derivative works from the Service, except as explicitly permitted.

6. User-Generated Content & External Integrations

If the Service allows you to connect external accounts (e.g., email, calendar, contacts) or otherwise link external data:

• You are responsible for ensuring you have the rights and permissions to share that data with Duchas.
• Duchas is not liable for any loss or misuse of data you share via these integrations (subject to our Privacy Policy and best efforts).

7. Disclaimer & Limitation of Liability

• The Service is provided "as is" and "as available." Duchas disclaims all warranties, whether express or implied, including but not limited to warranties of accuracy, reliability, fitness for a particular purpose, availability, or non-infringement.
• Under no circumstances shall Duchas (or its affiliates, employees, partners) be liable for any indirect, special, incidental, punitive or consequential damages (including lost profits, data loss, service downtime), arising from your use (or inability to use) the Service, even if advised of the possibility of such damages.

8. Termination

• Duchas may suspend or terminate your access to the Service at any time — without prior notice — if you breach these Terms or engage in prohibited conduct.
• You may also terminate your account at any time by contacting us, subject to the terms of our Privacy Policy regarding data deletion.

9. Modifications to Terms

We may modify these Terms from time to time (e.g., for new features, legal reasons, business changes). When we do, we'll post the updated Terms and indicate the effective date. Your continued use after changes constitutes acceptance of the modified Terms.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising from or related to this agreement shall be resolved in the competent courts of Gujarat, India.
